1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the NomadMode application and related services (collectively, the "Service") provided by Ilix OÜ ("NomadMode", "we", "us", or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms; if you do not agree, you must not use the Service.
2. Eligibility
The Service is intended only for users aged 18 or older; the Service is not offered to users under 13 and is not directed to children.
By using the Service, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.
3. Accounts
To use certain features, you may need to create an account and provide accurate, current, and complete information, including your name/username and email address.
You are responsible for safeguarding your login credentials, for all activities under your account, and for notifying us promptly of any unauthorized use or security breach.
4. Subscriptions, Fees, and Payments
NomadMode may offer both one‑time purchases and recurring subscriptions ("Subscription") for premium features or services.
When you subscribe, you authorize us and/or our payment processors (such as Apple App Store or Google Play) to charge the applicable fees using a valid payment method in accordance with the billing cycle displayed at purchase.
Subscription renewals occur automatically at the end of each billing period unless you cancel through the relevant app store account settings or as otherwise described in the Service.
Fees, pricing tiers, and features available under free or paid plans may change from time to time; continued use of the Service after such changes constitutes your acceptance.
5. Refunds
Refunds may be granted only where required by applicable law or store policies, or at our sole discretion on a case‑by‑case basis.
Where purchases are made through third‑party app stores, any refund process may be administered by those third parties under their rules.
6. Use of the Service
NomadMode is a digital tool that helps users discover, organize, and manage travel‑related information, including geolocation features, Google Maps‑based functionality, and content such as affiliate offers and promotions.
You agree to use the Service only for lawful purposes, in compliance with these Terms and all applicable laws, including travel, consumer, data protection, and platform rules.
7. User Content
The Service may allow you to submit, upload, or share content such as locations, travel notes, reviews, or profile information ("User Content").
You remain the owner of your User Content but grant NomadMode a worldwide, non‑exclusive, royalty‑free license to host, use, display, reproduce, and adapt such content solely as necessary to operate and improve the Service.
You represent and warrant that you have all necessary rights to your User Content and that it does not infringe or violate any third‑party rights or applicable laws.
We may remove or disable access to any User Content that we believe violates these Terms or applicable law, without prior notice.
8. Third‑Party Services, Links, and Affiliate Offers
The Service may integrate third‑party services, including:
- Google Maps API and other mapping tools
- Analytics providers
- Social login providers such as Google Sign‑In
- Payment processors
- Affiliate networks and promotional partners
These third parties operate under their own terms and privacy policies, and NomadMode does not control and is not responsible for their content, availability, or practices.
Some links or offers displayed in the Service may be affiliate links or sponsored promotions, meaning NomadMode may receive compensation when you interact with or purchase from such partners; this does not affect the price you pay.
9. Analytics and Tracking
NomadMode uses analytics tools (such as Firebase Analytics or similar equivalents) and certain tracking technologies (including session cookies, authentication cookies, and local storage) to operate, secure, and improve the Service.
By using the Service, you consent to such technologies as described in the Privacy Policy, subject to your rights and preferences under applicable law.
10. Intellectual Property
The Service and all related content, features, and functionality (excluding User Content) are owned by Ilix OÜ or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You receive a limited, non‑exclusive, non‑transferable, revocable license to use the Service for personal, non‑commercial purposes, subject to these Terms.
11. Prohibited Conduct
You agree not to:
- Copy, modify, or create derivative works based on the Service, except as expressly allowed by law
- Reverse engineer, decompile, or attempt to extract source code from the Service, except as permitted by applicable law
- Use the Service to send spam, engage in fraudulent or misleading practices, or violate any third‑party rights
- Access the Service using automated means (such as bots or scrapers) except where explicitly allowed
12. Geolocation and Safety
Certain features may require access to your device's location in order to provide location‑based content, maps, or recommendations.
You are solely responsible for your personal safety and compliance with local regulations when acting on any location‑based suggestions, and NomadMode has no responsibility for conditions, accessibility, or safety of any location or venue.
13. No Professional Advice
Content in the Service, including travel tips, costs, or availability information, is provided for general informational purposes only and does not constitute professional, legal, financial, or other specialized advice.
You are solely responsible for verifying all information, including entry requirements, safety guidance, and local rules, before making decisions or travel arrangements.
14. Limitation of Liability
To the fullest extent permitted by law, NomadMode and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the Service.
NomadMode is not responsible for errors, inaccuracies, delays, or interruptions in third‑party data, geolocation, or affiliate content, nor for any decisions you make based on such information.
15. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non‑infringement.
NomadMode does not guarantee that the Service will be uninterrupted, secure, error‑free, or free of harmful components, or that any defects will be corrected.
16. Termination
You may stop using the Service at any time and may request closure of your account as described in the Service or by contacting us.
We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, create a risk to us or other users, or where required by law or platform rules.
17. Governing Law and Disputes
Unless mandatory law requires otherwise, these Terms and any dispute arising out of or in connection with them shall be governed by the laws of Estonia, without regard to its conflict‑of‑law provisions.
Any disputes shall be submitted to the competent courts of Estonia, except where consumer protection or other mandatory rules grant you the right to bring claims in another jurisdiction.
18. Changes to the Terms
We may update or modify these Terms from time to time; updated versions will be posted in the Service with a revised "Last updated" date and, where required, a notice before they take effect.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance; if you do not agree, you must stop using the Service.
